Fair remuneration of copyright and related rightsholders over musical works: The landfill of buyout practices

EU and national law recognise the principle of fair and appropriate remuneration for both authors and performers, establishing this as an equal level of high protection and a core principle of copyright and related–rights law. However, the ongoing and emerging trend of buyout agreements, the unilateral enforcement of buyout clauses, and related practices undermine the rule of law and threaten the continued creation of music.
As the digital era gives way to the age of AI, we increasingly hear the voices of authors and performers calling for concrete protective measures. This presentation will explore the impact of buyouts with the aim of highlighting current challenges and amplifying the need for reform.
